Users shall use the services of IgoSil in accordance with these Terms of Use. Only those who have reviewed and accepted these Terms of Use may use the services. These Terms of Use are originally written in Japanese, and any translations into languages other than Japanese are provided solely for reference. Only the Japanese text shall have legal effect.
Article 1 (The Service)
"IgoSil" (hereinafter referred to as the "Service") refers to all content and information, including the Go learning support services operated by UNBALANCE Corporation (hereinafter referred to as the "Company") and related email services. Some parts of the Service and content are available free of charge, but payment of fees is required to use all services.
Article 2 (Users)
A "User" of the Service refers to a person who uses the Service by the method prescribed by the Company.
Article 3 (Conditions of Use of the Service)
The Company may send various emails, including important notices, to the User's registered email address or other contact information as part of Service operation or features. The Company may post advertisements from third-party companies on all pages related to the Service and in emails sent to Users. The Company may review content posted by Users on the Service and, if it violates or is likely to violate the prohibited acts set forth in these Terms of Use, may delete such posts and, if necessary, report them to the police or other authorities. The Company may share and link information, comments, content, points, etc., between the Service and websites provided via mobile phones, PCs, and smartphones operated by the Company other than the Service. The Company may change or delete any information provided on the Service without prior notice. All usage rights of the User in the Service shall be extinguished when the account is deleted, regardless of the reason. Please note that once an account is deleted, even mistakenly, it cannot be restored. The right to use the Service, including the account, belongs exclusively to the User personally and may not be transferred, lent, or inherited by third parties.
When changing mobile communication devices, the User agrees to the following:
- These Terms of Use shall apply even after the device change.
- To use the Service after changing devices, the User must download the necessary application to the new device at their own expense, and any communication charges incurred for such download shall be borne by the User.
- Play records and other data from the previous device may not be carried over.
- Even if the new device does not support the Service, usage fees for paid services will continue unless the User cancels the Service.
The User shall manage their password and User ID related to the Service at their own responsibility and comply with the following:
- Do not disclose, allow use by third parties, lend, transfer, change ownership, or sell their password or User ID.
- Use a password that is not easily guessed by third parties.
- When using the Service on a computer or mobile device shared by multiple people, log out and close the browser when finished.
If the Service is used with a registered password and User ID, the Company shall regard such use as by the User who registered, and the User shall bear all responsibility for the results, with the Company assuming no liability. If the User’s improper use of their password or User ID causes damage to the Company or third parties, the User shall compensate such damages. The Company may change the conditions of use of the Service at its discretion without prior notice.
Article 4 (Handling of Personal Information)
The Company shall handle Users' personal information appropriately in accordance with the separately posted Privacy Policy, and Users shall consent to this. The Company pays maximum attention to security to safely manage information collected from Users. The Company may collect, use, store, transmit, and disclose statistical data related to the Service (including user scores, rankings, etc.), and Users consent to this.
Article 5 (Prohibited Acts)
Users shall not engage in the following acts. If violated, the Company may suspend part or all of the User's use of the Service without prior notice. Whether a violation has occurred shall be determined by the Company.
- Acts that interfere with the operation or system of the Service.
- Unauthorized alteration, falsification, or deletion of content.
- Sending or posting harmful computer programs.
- Damaging the honor or credibility of the Company or third parties.
- Acts contrary to public order and morals.
- Criminal acts or acts related to or potentially leading to criminal acts.
- Impersonating other Users.
- Infringing intellectual property rights, privacy, or other rights of the Company or third parties.
- Defamation, threats, harassment, or causing economic or mental damage to other Users.
- Aggressive criticism identifying other Users by User ID, nickname, or name.
- Acts leading to discrimination based on ethnicity, race, gender, age, etc.
- Posting violent or obscene images (illustrations), videos, or other content deemed obscene.
- Posting links to adult sites, child prostitution/pornography, or uncensored video downloads.
- Soliciting or inducing encounters for sexual or obscene acts.
- Sales of goods or other commercial/for-profit activities.
- Posting or sending the following in the Service:
- Information for commercial advertising or promotion.
- Information containing affiliate links.
- Solicitation via pyramid schemes, chain mail, multi-level marketing, or lead mail.
- Inducing or directing others to adult sites (including linking).
- Indiscriminate messaging or footprinting.
- Posting or sending identical or similar content.
- Posting unrelated words repeatedly in areas of the Service.
- Posting excessively long text or large amounts of words.
- Posting the same URL repeatedly.
- Any other act the Company deems spam.
- Impersonating others, falsely claiming organizational representation, or falsely claiming partnerships.
- Collecting or storing personal information of other Users.
- Copying, reproducing, uploading, posting, transmitting, or distributing Service-related content without permission.
- Holding multiple accounts by one User.
- Other acts violating these Terms of Use or deemed inappropriate by the Company.
Article 6 (Penalties for Prohibited Acts)
If the Company determines that a User has violated or is likely to violate these Terms of Use, the Company may suspend part or all of the Service without notice and bears no responsibility for any damages incurred by the User. The Company may, at its discretion, delete all data related to such User, and bears no responsibility for resulting damages. The Company may refuse future use, including registration, of the Service to Users determined to have violated these Terms in the past. If a User unlawfully acquires prizes or goods by improper use deviating from the Service’s intent, the Company may revoke such acquisition.
Article 7 (Disclaimer)
The Company bears no responsibility and no obligation to compensate for any damages suffered by Users or third parties from use of the Service. The Company provides no warranty regarding information provided through the Service (content, advertisements, or third-party information). If disputes arise between Users, except in cases of malicious conduct, such disputes shall be resolved between the parties, and the Company assumes no responsibility. The Company provides no warranty for the legality, morality, copyright authorization, or accuracy of websites linked within the Service. The Company provides no warranty that the Service is free from defects (including safety, reliability, accuracy, completeness, validity, suitability for specific purposes, security, errors, bugs, rights infringements, etc.). Nor is the Company obligated to correct such defects. The Company shall not be liable for damages arising from breach of contract or tort due to negligence (excluding gross negligence) if such damages arise from special circumstances foreseeable by the Company or User. Compensation is limited to the amount of usage fees received in the month the damage occurred.
Article 8 (Temporary Suspension, Modification, or Termination of the Service)
The Company may temporarily suspend the Service without prior notice in the following cases:
- When performing regular or emergency maintenance or updates of the Service system
- When the Service becomes difficult to provide due to fire, power outage, natural disasters, or other force majeure
- When telecommunications services are not provided by the carrier
- Other cases where the Company determines that providing the Service is difficult
The Company may, at its discretion and without prior notice, add, modify, suspend part of, or terminate the entire Service. If the entire Service is terminated, the Company shall notify Users in advance in a manner specified by the Company.
Article 9 (Paid Services)
Paid services of the Service are provided under the following conditions:
Application: Users shall apply through procedures prescribed by the Company (as instructed in the app or on the website).
Payment methods: Users may select from the following (subject to change at the Company’s discretion):
(1) In-App Purchase (iPhone/iPad).
(2) Google Play Billing (Android).
Usage fees: Some parts of the Service are free. For paid services, Users shall pay fees separately determined by the Company in the prescribed method.
Cancellation: Once applied for, cancellations or refunds of paid services are not possible for any reason.
Withdrawal: Users shall withdraw from monthly paid services through procedures of the payment provider.
Refund: Even if withdrawn, or if the Service is temporarily suspended due to network/server failures, no refunds shall be made for fees already received.
Suspension: If payment is not made, the Company may suspend use of paid services without notice.
Article 10 (Intellectual Property Rights)
All rights (ownership, intellectual property rights, portrait rights, publicity rights, etc.) to content of the Service (texts, images, programs, etc., excluding content created by Users themselves) belong to the Company or third parties. Users grant the Company a worldwide, non-exclusive, free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works, display, and perform all information posted, uploaded, or stored by Users on the Service ("User-Posted Information"). Users also grant other Users a non-exclusive license to use such information within the Service. The Company may store and use User-Posted Information for smooth operation, improvement, promotion, etc. of the Service. Users agree not to exercise moral rights of authors. Even after withdrawal or discontinuation of the Service, this Article remains valid, and Users may not edit/delete or request deletion of past posts. If a User violates this Article, the Company may seek injunctions and damages equivalent to profits gained from such violation. If third-party rights are infringed by User-Posted Information, the User shall resolve the matter at their own expense and responsibility and indemnify the Company.
Article 11 (Compensation)
If claims or expenses arise against the Company due to a User’s actions in the Service, the User shall bear such expenses and compensation (including attorneys' fees).
Article 12 (Changes to the Terms of Use)
The Company may change, add, or delete these Terms of Use without notice. Changed Terms will be displayed in the Service, and Users shall be deemed to have agreed by using the Service after such display.
Article 13 (Governing Law and Jurisdiction)
These Terms of Use shall be governed by Japanese law. The Tokyo District Court or Tokyo Summary Court shall be the exclusive court of first instance for all disputes arising from or relating to these Terms of Use or the Service.
